Online Banking Agreement
- 1. General
-
This Online Banking Agreement, which may be amended from time to time by us (this "Agreement"), for accessing your Argentine Federal Savings account(s) via the Internet explains the terms and conditions governing the use of Argentine Federal Savings' Internet banking product, "Online Banking", and other banking services offered through Argentine Federal Savings (collectively, "Online Banking Services"). By using Online Banking you agree to abide by the terms and conditions of this Agreement in addition to any other deposit or similar agreements to which you are bound. This Agreement will be governed by and interpreted in accordance with federal law and regulation, and to the extent there is no applicable federal law or regulation, by the laws of the State of Kansas. The terms "our," "we," and "us," refer to Argentine Federal Savings. "You" refers to each signer on an account. The term " business day" means Monday through Friday, excluding banking holidays.
Online Banking can be used to access products and accounts made available by Argentine Federal Savings. Each of your accounts is also governed by the applicable Account Disclosure and Agreement.
Each time you use Online Banking, you permit any other person to use Online Banking, or any of your employees or agents uses Online Banking, you are agreeing to the terms and conditions that we have set out in this Agreement and in any other agreement applicable to your account. Also, each time you use Online Banking, you permit any other person to use Online Banking, or any of your employees or agents uses Online Banking, you are acknowledging receipt and understanding of all disclosures included in or with this Agreement.
- 2. Protecting your Account

You agree to notify us at once if you believe another person has improperly obtained your Online Banking password. Also notify us if someone has transferred or you think someone may transfer money from or to any of your account(s) without your permission, or if you suspect any fraudulent activity on your account. To notify us, contact Argentine Federal Savings' Central Operations Department at PO Box 6269, Kansas City, KS, 66106, or you may call us at 1-888-216-8072 between the hours of 9:00 a.m. to 5:00 p.m. Central Time on any business day. Telephoning is the best way of keeping your losses down. You should then follow up by notifying us in writing. You could lose all the money in your account (plus your maximum overdraft line of credit, if applicable).
A. Your Liability: (Consumer Accounts Only) If your Online Banking password has been compromised and you tell us within two (2) business days after learning of the loss or theft, you can lose no more than $50 if someone used your Online Banking password without your permission to access a Argentine Federal Savings deposit account. If you do NOT tell us within two (2) business days after you learn of the loss or theft, and we could have stopped someone from taking money without your permission had you told us, you could lose as much as $500 of the disputed amount.
If your monthly statement shows withdrawals, deposits, transfers or purchases that you did not make or authorize, you must notify us at once. If you do not notify us within sixty (60) days after the account transaction detail information was transmitted or mailed to you, and we could have stopped someone from taking money if you had told us in time, you may not get back any money lost after the sixty (60) days. If there are extenuating circumstances that kept you from telling us, the time periods in this section may be extended.
B. Preventing Misuse: You understand and agree that it is extremely important that you take an active role in the prevention of any wrongful use of your account. If you find that your records do not agree with ours, you agree to immediately call Argentine Federal Savings at 1-888-216-8072 between the hours of 9:00 a.m. to 5:00 p.m. Central Time on any business day.
The following guidelines should assist you in ensuring that your accounts and account information remain secure:
- Do not send your Access ID or Password or privileged account information over any e-mail system.
- Do not leave your Computer unattended while you are connected to Online Banking.
- Do not enter your Access ID or Password into Online Banking when there are others nearby who could observe you doing so.
- We recommend that you log out of Online Banking and close your browser completely after each session and/or clear cache and history.
- We recommend that any computer you use to access Online Banking have spyware protection, virus protection and a personal firewall. Moreover, keeping your machine updated with the latest security patches is also good practice.
Protect Your Online Banking Password. The password that is used to gain access to Online Banking should be kept confidential at all times. It is recommended that you memorize this password and do not write it down. You agree to keep your password, account numbers and other account data confidential. If you believe that your password may have been lost or stolen, or that someone has transferred or may transfer money to or from your account without your permission, you agree to notify Argentine Federal Savings at once.
- 3. Accessing Your Argentine Federal Savings Accounts

A. Enrollment: You must enroll in Online Banking thereby accepting the terms of this Agreement, and have an authorized username and password. In addition, you must have the required secure Internet browser software as defined by Argentine Federal Savings.
Customers must submit a Non-Personal Enrollment Form to request access to non-personal accounts for which they are authorized signers. This means, for example, that an Enrollment Form must be completed to access non-personal accounts that have the following ownership:
- Corporation
- LLC
- Partnership
- Revocable and Irrevocable Trusts (using a non-personal EIN)
B. Eligible Accounts: Each Argentine Federal Savings product you have with us is called an "Eligible Account". Eligible Accounts include deposit accounts, loans and lines of credit you maintain with Argentine Federal Savings. Each of your Eligible Accounts will continue to be subject to the agreement that already applies to it. In the event there is any conflict between this Agreement and agreement(s) for your Eligible Accounts, or if any agreement for your Eligible Accounts contains a provision that is not in this Agreement, your agreement for your Eligible Account will take precedence over this Agreement but only to the extent it applies to that particular Eligible Account. Joint account owners have the right to any information or to make any request associated with their account. Please refer to the agreement(s) governing your Eligible Accounts for more information.
C. Linked Eligible Accounts: All Eligible Accounts will be linked together and will appear together only if your tax identification number is associated with the account and the account ownership meets Argentine Federal Savings authorized access requirements. This means, for example, that when you access the Online Banking Service, you will be able to view and access at a single time the following accounts:
- any consumer accounts that meet the criteria as stated above;
- any trust accounts for which you are a trustee of the account; and
- any retirement accounts for which you are the owner of the account; and
- any custodial accounts for which you are the custodian of the account.
D. Non-Eligible Accounts: Not all accounts are eligible Argentine Federal Savings accounts. As an example, accounts with two signatures required and other such restrictions are not eligible Argentine Federal Savings accounts.
E. New Services: Argentine Federal Savings may, from time to time, offer and introduce new Online Banking services. Argentine Federal Savings will notify you of the existence of these new products and services. By using these services when they become available, you agree to be bound by the rules, which will be communicated to you, concerning these services.
F. Fees: There may be monthly or transaction fees for accessing your account(s) through the Internet, including the Online Banking Access Fee for services performed within the Online Banking Product.

- 4. Terms and Conditions

The signing of the Application or agreement to Argentine Federal Savings' Online Banking/Bill Payment Service confirms your agreement to be bound by all of the terms and conditions of this Agreement and acknowledges your receipt and understanding of all disclosures included in or with this Agreement.
A. Your Online Banking Password: You must select a password the first time you request access to your Argentine Federal Savings account(s). Do not use as your password words or numbers that are easily associated with you, such as your name, social security number, address or birth date. You are authorizing Argentine Federal Savings to act on instructions received under your password. You are responsible for keeping your password, account number(s) and other account data confidential at all times.
B. Our Liability: Except as specifically provided for in this Agreement or where the law requires a different standard, you agree that neither Argentine Federal Savings nor the Internet service provider shall be responsible for any loss, property damage or bodily injury, whether caused by Argentine Federal Savings, equipment, software, or Internet service providers or any agent or subcontractor of any of the foregoing. Nor shall Argentine Federal Savings or the Internet service providers be responsible for any direct, indirect, special or consequential, economic or other damages arising in any way from the installation, use or maintenance of the equipment, software or Internet browser or access software.
C. Changes to Fees or Other Terms: We reserve the right to change the fees or other terms described in this Agreement or to add new fees and terms. However, when changes are made to any fees, we will notify you on-line, or will send a notice to you at the address shown on our records. All notices will be sent at least thirty (30) days in advance of the effective date of the change, unless an immediate change is necessary to maintain the security of the system. If such a change is made, and it can be disclosed without jeopardizing the security of the system, we will provide you with written or electronic notice within thirty (30) days after the change. By continuing to use the accounts or services to which these changes relate, you are accepting the changes. Changes to fees applicable to specific accounts are governed by the applicable Account Disclosure and Agreement and Schedule of Fees and Charges.
D. Disclosure of Account Information: You authorize Argentine Federal Savings to disclose to selected third parties about your account or the transactions you make as set forth in Argentine Federal Savings' Privacy Policy provided to you at account opening and which may be modified from time to time. You can also access this policy by clicking the "Privacy Policy" link on our Web site.
E. Other General Terms: In addition to this Agreement, you agree to be bound by and will comply with the requirements of the applicable Account Disclosure and Agreement, initial disclosures, other disclosures and schedules (as the same may be modified from time to time), the terms or instructions appearing on a screen when using the Online Banking Service, Argentine Federal Savings' procedures and policies applicable to each Eligible Account and each Online Banking Service, the rules and regulations of any funds transfer system to which Argentine Federal Savings belongs, and all applicable Federal and State laws and regulations.
Argentine Federal Savings reserves the right to terminate this Agreement and your access to Online Banking in whole or in part, at any time without prior notice.
If you do not access your accounts via the Internet for any six (6) month period, Argentine Federal Savings reserves the right to disconnect your service without notice.
You agree to be responsible for any telephone charges incurred by you in accessing your accounts through Online Banking.
- 5. Bill Payment

As part of Online Banking, you can schedule payment of your periodic bills. You can arrange for the payment of current, future and recurring bills from your Argentine Federal Savings checking account. Bills may be paid in two ways, via check or electronically via ACH (e-bill). There is no limit to the number of payments that may be authorized, subject to the terms of your checking account. There are frequency limits that may apply to a money market checking account. You may make a maximum of six (6) preauthorized, automatic or telephone transfers per monthly statement cycle on a money market checking account. No more than three (3) of the six (6) transfers may be made by check, draft, debit or similar order made by you and payable to third parties, including point-of-sale transactions. Unlimited loan payments are permissible by any means and are not included in the six (6) transfer limitation. Additional limitations apply to transfers as noted in the Other Information section.
By furnishing us with the names of your payees/merchants and their addresses, you authorize us to follow the payment instructions to these payees/merchants that you provide through Online Banking. You may pay up to 50 payees using Bill Payment. When we receive a complete payment instruction (for current or future date) containing all necessary information needed to initiate payment, we will remit funds to the payee on your behalf, from your designated checking account, on the day you have instructed the payment to be sent (the "Payment Date"). However, we shall not be obligated to make any such payment unless your account and/or overdraft protection plan has sufficient funds or credit availability to pay the bill on the date the check or other item is presented to us for payment from your account. Funds for all non-electronic bill payments will be withdrawn from your account on the day the check is presented to us for payment. Funds for all electronic bill payments will be withdrawn from your account on the same day as your payment Send Date.
You understand and agree that any payments made through Bill Payment require sufficient time for your payee to credit your account properly. To avoid incurring a finance charge or other charge, you must schedule a payment far enough in advance of the due date of your payment. You must allow at least ten (10) business days from the Payment Date for a check to reach the payee and three (3) business days from the Payment Date for an electronic payment to reach the payee.
Argentine Federal Savings shall not be responsible for any charges imposed or any other action taken by a payee resulting from a payment that you have not scheduled properly, including any applicable finance charges and late fees. In addition, Argentine Federal Savings will not be liable if any third party through whom any bill payment is made fails to properly process the payment to the intended payee. Argentine Federal Savings will not be liable for delays or losses of payments caused by the U.S. Postal Service or other delivery service. We will also not be liable if there are insufficient funds or credit availability (if applicable) in your designated payment account and/or overdraft protection plan; if a legal order directs us to prohibit withdrawals from the payment account; if the payment account is closed or frozen; or if any part of the electronic funds transfer system is not working properly. Argentine Federal Savings will not be liable for bill payments not completed due to circumstances beyond our control (such as fire, telecommunication outages, strikes, or natural disasters). Argentine Federal Savings will not be liable for indirect, special, or consequential damages arising out of the use of Bill Payment. Argentine Federal Savings will not be liable if a payee delays posting or will not accept payments made through Bill Payment.
Argentine Federal Savings reserves the right to terminate your use of Bill Payment at any time without prior notice.
Additional fees may also be assessed due to special requests made by you. This includes requests for stop payments. A non-sufficient funds fee will be charged for all checks and e-bills returned unpaid. Fees will be charged each time an attempt is made to pay the check or e-bill but cannot due to insufficient funds in the account. Please refer to Argentine Federal Savings' Schedule of Fees and Charges for fee information.
If the payment account has insufficient funds to cover the fees, Argentine Federal Savings may deduct the fee from any other transaction account linked to Online Banking. If the fee cannot be paid, we may cancel your Bill Payment service.
Argentine Federal Savings will not be responsible for late payment charge, finance charge, penalty or default assessed by merchants related to payments initiated through the Bill Payment service. This includes any fees or charges that may result from, but are not limited to, your failure to enter payment authorizations in sufficient time to reach the merchant by the due date, merchant delays in or inability to process payments received, payment lost or delayed by the mail service, or any data entry errors you make (including, but not limited to, incorrect merchant name or address, account number, or remittance amount) that may result in payment not being received or processed properly by merchants.

Balance Inquiries and Transfers
You may access your Argentine Federal Savings account(s) through Online Banking by going to www.argentinefed.com you may:- transfer funds from checking to checking
- transfer funds from checking to savings
- transfer funds from savings to checking
- transfer funds from savings to savings
- make payments from checking or savings to loan accounts with us
- make payments from checking to third parties
- get information about:
- the account balance of savings accounts, checking accounts, loan accounts, and certificates of deposit accounts
- account history
In order to initiate one of these transactions, you must first use your password and login name to obtain access to the Online Banking Services. The balance shown on your PC may include deposits still subject to verification by us. The balance shown also may differ from your records because it may not include deposits in progress, outstanding checks, or other withdrawals, or charges. A funds transfer request will not result in immediate funds availability because of the time required to process the files. The deadline for funds transfer requests is 5:00 p.m. Central Time for same business day availability. Any funds transfer requests received after 5:00 p.m. Central Time will not be processed until the following business day. If there are insufficient available funds in an account from which you are requesting a funds transfer, the transfer will not be initiated. For monetary transfers between accounts at Argentine Federal Savings, the accounts must have the same password and have at least one tax identification number in common.
There are frequency limits that may apply when transferring funds from a savings or a money market account. You may make a maximum of six (6) preauthorized, automatic or telephone transfers per monthly statement cycle on a savings or money market account. No more than three (3) of the six (6) transfers may be made by check, draft, debit or similar order made by you and payable to third parties, including point-of-sale transactions. Unlimited loan payments are permissible by any means and are not included in the six (6) transfer limitation.
Statements All of your payments and funds transfers made through Online Banking will appear on your account statement(s).
Equipment We are not responsible for any loss, damage or injury resulting from an interruption in your electrical power or telephone service; the disconnecting of your telephone line by your local telephone company or from deficiencies in your line quality; or any defect or malfunction of your PC, modem, or telephone line. We are not responsible for any services relating to your PC other than those specified in this Agreement. If any equipment failure occurs in any way relating to your PC, modem, or telephone line, Argentine Federal Savings is not responsible.
Cancellation or Stop Payment If you have scheduled payments out of your account through Bill Payment services and they have not yet paid against your account, you may cancel these payments without incurring fees by following the cancel payment instructions available online in the Bill Pay service help screens. To place a stop payment on a check issued, follow the online instructions listed in the Customer Service tab on the web site. We will charge your account a fee for each stop payment order. Please refer to Argentine Federal Savings' Schedule of Fees and Charges for fee information. Stop payments cannot be placed on electronic-bills.
Liability for Failure to Stop Payment of Preauthorized Transfer. If you request a Stop Payment, we receive it in time to give us a reasonable opportunity to act on it before our stop payment cutoff time, and we do not stop the payment, we will be liable for your losses or damages up to the amount of the payment at issue.
Transfers If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses up to the amount of the transfer. We will not be liable:
- If, through no fault of ours, you do not have enough money in your account to make the transfer.
- If you have an overdraft line and the transfer would go over the credit limit.
- If the terminal or system was not working properly and you knew about the breakdown when you started the transfer.
- If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken.
Error Resolution Notice In case of errors or questions about your electronic transfers, call or write us at the telephone number or address listed in this Agreement as soon as possible, if you think your statement is wrong or if you need more information about a transfer listed on the statement. We must hear from you no later than 60 days after we sent the FIRST statement on which the problem or error appeared.
- Tell us your name and account number (if any).
- Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.
- Tell us the dollar amount of the suspected error.
If you tell us orally, we will require that you send us your complaint or question in writing within 10 business days.
We will determine whether an error occurred within 10 business days (20 business days if the transfer involved a new account) after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days (90 days if the transfer involved a new account) to investigate your complaint or question. If we decide to do this, we will credit your account within 10 business days (20 business days if the transfer involved a new account) for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your account. Your account is considered a new account for the first 30 days after the first deposit is made, unless each of you already has an established account with us before this account is opened.
We will tell you the results within three (3) business days after completing our investigation. If we decide there was no error, we will send you a written explanation.
You may ask for copies of the documents that we used in our investigation.
Business Days/Hours of Operation Online Banking is available 24 hours a day, seven days a week, except during maintenance periods for modifications or upgrades.
- 7. Provisions Applicable to Non-Personal Accounts

Non-Personal entities are eligible for Online Banking with respect to eligible non-consumer deposit accounts and eligible non-consumer loan accounts. We reserve the right to limit access to Online Banking. After we process your submitted application we will notify you via email of acceptance or denial. Consumer accounts may not be linked to non-consumer accounts unless we otherwise agree. If you enroll non-consumer and consumer accounts under the same access identification, and persons other than yourself (such as employees of your business) are provided with access to transact in Online Banking, you acknowledge you are at risk for their access to your personal accounts.
Non-Personal entities will designate an Administrator who must be an authorized signer on all eligible accounts enrolled in Online Banking and whose responsibilities shall include, among other matters:
- Enrolling the non-personal account (NPA) in Online Banking.
- Assigning authorized non-personal account users.
- Assigning and maintaining all access codes for authorized NPA users.
- Advising Argentine Federal Savings when adding or removing eligible accounts from Online Banking.
- Maintaining the ability of the authorized users to access services available through Online Banking, including transaction rights for each authorized user, designating another user to be a successor Administrator who will, when authorized, possess the Administrator's capabilities; any change of Administrator must be conveyed, in writing, to Argentine Federal Savings.
Online Banking shall only be used by the Administrator and authorized users and only for legitimate business purposes incurred in the ordinary course of their employment or agency with the NPA. You agree to limit the use of Online Banking to such purposes and to take all necessary steps to ensure that Online Banking is used for no other purpose.
You are liable for all transactions that you or any authorized users (including the Administrator) make or authorize, even if that person exceeds the authority granted to them. You will also be liable for transactions by an authorized user until you have notified us of revocation of the authorized user's authority, and we have had a reasonable time to act on such notice to block the affected access device. You are also liable for any and all unauthorized use that occurs before you have notified us that a User ID, Password, or other access means in your possession or control has been lost, stolen or used without your authority and before we have had a reasonable opportunity to block the affected access device(s). Your designation of a User ID and Password and/or use of Online Banking services constitute your agreement that our security procedures are commercially reasonable.
Argentine Federal Savings may act on the instruction of the Administrator until Argentine Federal Savings shall have received written notice to the contrary from the Administrator or an officer of the company authorized to give such notice on behalf of the Company. Argentine Federal Savings shall be given a reasonable time to act on such written notice.
In consideration for receiving the ability to transact transfers between accounts, you agree to hold Argentine Federal Savings harmless and indemnify Argentine Federal Savings from and against any and all loss, cost or expense, including reasonable attorney's fees, resulting from Argentine Federal Savings acting upon any previous transfer requests which have been initiated by you, any Administrator, or any NPA user in regard to any of your Argentine Federal Savings accounts and Online Banking.
If you, your Administrator or any of your employees or agents uses any of the Online Banking Services to request an advance under any line of credit extended to you by Argentine Federal Savings, whether or not such request is authorized by you, such advance shall be deemed outstanding indebtedness under the applicable line of credit unless (i) we had actual knowledge that a request for an advance was unauthorized by you or (ii) you had provided us with written instructions to not allow advances via the Online Banking Services and sufficient time to act on such instructions.
